Is Mediation Right for You?

Divorcing In New Jersey

Getting a divorce can be a frightening and overwhelming prospect. You may have heard that divorces cost thousands of dollars and that the stress of dissolving a marriage — especially if you have kids — can take an extreme toll on your family.

Fortunately, not all divorces are like this. Mediation is an efficient way to handle each aspect of your divorce, from alimony to property division, in a neutral setting outside of court. But is it right for you?

Can You and Your-Ex Spouse Agree on Matters?

For mediation to be successful, both spouses must be able to agree on each particular matter in the divorce. This includes child custody, alimony, the division of property and debts, and other issues within the divorce.

Even if you and your ex-spouse don’t agree on everything to begin with, if you’re able to make compromises and talk through issues together amicably, mediation may be the right choice for you.

Do You Have Children?

The stress of a traditional divorce can be particularly difficult for children. Even young children can sense the stress and challenges faced by a parent going through a challenging divorce.

If you have children with your ex-spouse, consider mediation as a way to speed up the divorce process and keep your children from being dragged through a custody battle. Sometimes custody disagreements are unavoidable, but if possible, mediation can help you reduce the stress that your divorce will have on your children.

Do You Stand to Gain a Lot Financially from Your Divorce?

If you stand to gain a significant amount of money from your divorce, especially if you do not have a prenup, and your ex-spouse isn’t agreeable on the amount, mediation might not be in your best interests.

This is most common in high net worth marriages, where one spouse could potentially gain a great deal of property or liquid assets were the case to go in front of a judge.
